We’re here to provide you with the information, resources, and means needed to begin the process of medical marijuana therapy in your daily life.

Process

The legalization of Medical Marijuana is a big step for our state, which is why we want to help those looking to alleviate their pains get the proper medical product.

The Process

  1. Patient has medical complaint

    • Patient schedules an appointment with their physician.

  2. Patient sees their provider

    • A determination is made by the provider whether the patient would benefit from the therapeutic or palliative use of medical cannabis for their qualifying condition. If yes, a medical certification is issued through the online portal for the patient. The provider must create an account at medcannabisapplication.sd.gov to provide written certification.

  3. Patient applies with the Department of Health

    • Patient receives an email to create an account on medcannabisapplication.sd.gov. Once complete, the patient must wait for DOH approval.

  4. Caregiver applies with the Department of Health

    • Some applications, including minor patient applications, require caregivers to be registered. Caregivers will receive an email to create an account on medcannabisapplication.sd.gov. Once complete, the caregiver must wait for DOH approval.

  5. Patient shops at dispensaries

    • Once the patient or caregiver gets DOH approval, a medical cannabis card will be mailed to the patient or caregiver. The cardholder may then purchase cannabis from a certified dispensary.

Brett M. Johnson PA-C - Physician Assistant Specialist

Brett was born and raised in north central South Dakota to a large family with an incredibly strong ranching background and has been in the medical field for over 15 years. He graduated Magnum Cum Laude from Presentation College in Aberdeen, SD in 2007 with a Bachelors of Science in Radiologic Technology and a minor in Health Care Administration. He worked in the northern Black Hills in the radiology field for seven years and was then accepted to the Physician Assistant Program at the University of North Dakota obtaining Masters of Physician Assistant Studies with honors in 2016.

As a PA-C his primary focus has been Primary Care, Urgent Care and Emergency Medicine. Brett has been working with patients of all ages, developing a comprehensive history and physical exam, documenting all pertinent subjective and objective information in order to implement a thorough assessment and plan of care. He has worked with all acute and chronic medical conditions across the life span with compassion and with excellent patient satisfaction and outcomes. Brett M Johnson PA-C is an enrolled member of the Standing Rock Sioux Tribe and has dedicated the majority of his Physician Assistant work to Indian Health Service. He has also lived in the Lead/Deadwood area for 25 years raising two amazing sons.

 FAQs

  • Any sale or purchase of medical cannabis must comply with SDCL 34-20G and ARSD 44:90. Any sale or purchase of cannabis outside of the regulated medical cannabis establishments is illegal.

  • Under the new law passed by the voters, a condition that allows a patient to use medical cannabis must be a "debilitating medical condition," which is defined by SDCL 34-20G-1 as "a chronic or debilitating disease or medical condition or its treatment that produces one or more of the following: cachexia or wasting syndrome; severe, debilitating pain; severe nausea; seizures; or severe and persistent muscle spasms, including those characteristic of multiple sclerosis".

  • Yes. The renewal fee for a medical cannabis registry identification card is required at the time of renewal with no exceptions.

  • The South Dakota Medical Cannabis Program takes privacy and health information security seriously. The secure online registry system for patients, caregivers, practitioners, and law enforcement will meet or exceed all state and federal standards and HIPPA for confidentiality, accessibility, and information security.
